EaseEHR (“EaseEHR,” “we,” “us,” or “our”) respects the privacy of its Users (“User,” “your,” or “you”). This Privacy Policy (the “Privacy Policy”) explains how we collect, use, disclose, and safeguard your information when you use EaseEHR Platform (the “Platform”) through EaseEHR’ website at www.EaseEHR.com (the “Website”) or EaseEHR’ mobile application (the “App”). Beyond the Privacy Policy, User's use of EaseEHR is also subject to our Terms of Service (www.EaseEHR.com/termsofuse).

EaseEHR is committed to protecting the privacy of its Users whose information is collected and stored while using EaseEHR’ Platform through our Website or App.

The capitalized terms have the same meaning as ascribed in our Terms of Use, unless otherwise noted here.

  1. WHAT INFORMATION DO WE COLLECT AND HOW DO WE COLLECT IT?

  1. Information You Provide to Us

  1. Registration Information. When User signs up for an EaseEHR account, User gives us User's name, email address, and phone number. If User decides to sign up for EaseEHR using User's social media account, we will also get basic information from User's social media profile like User's name, gender, profile photo, and contacts.
  2. User Profile Information. When User joins the EaseEHR community, User can create an EaseEHR Profile to share fun facts about User, and discover mutual friends and interests. Filling out a profile is optional, and User can share as little or as much as User wants. User's name and profile photos are always part of User's profile. Read more below about how User can control who sees User's profile. User can also add a business profile to User's account, which requires a designated business email address and payment method.
  3. Payment Method. When an Organization adds a credit card or payment method to Organization's EaseEHR account, a third party that handles payments for us will receive the Organization's card information.
  4. Communications. If User contacts us directly, we may receive additional information about User. For example, when User contacts our Customer Support Team, we will receive User's name, email address, phone number, the contents of a message or attachments that User may send to us, and other information User chooses to provide.

  1. Information We Collect When You Use the Solutions

  1. Location Information. EaseEHR is all about empowering Clinician and Organizations. To do this, we need to know where you are. When you use the Solutions, we receive your location. We may also collect the precise location of your device when the Solutions is running in the foreground or background. If you label certain locations, such as "home" and "work," we receive that information, too.
  2. Your location information is necessary for things like matching Clinicians with nearby Opportunities and Organizations. In addition to the reasons described above, Clinicians location information is necessary for Electronic Visit Verification (EVV) services. If you give us permission through your device settings or the Solutions, we may collect your location while the app is off to identify promotions or service updates in your area.
  3. Device Information. EaseEHR receives information from Users' devices, including IP address, web browser type, mobile operating system version, phone carrier and manufacturer, application installations, device identifiers, mobile advertising identifiers, push notification tokens, and, if you register with your social media account, your social media identifier. We collect mobile sensor data from devices to improve location accuracy and analyze usage patterns.
  4. Usage Information. To help us understand how you use the Solutions and Services and to help us improve it, we automatically receive information about your interactions with the Solutions and Services, like the pages or other content you view, your actions within EaseEHR apps, and the dates and times of your visits.
  5. Call and Text Information. We work with a third party partner to facilitate phone calls and text messages. We receive information about these communications including the date and time of the call or SMS message, the parties' phone numbers, and the content of any SMS messages.
  6. User Feedback. At EaseEHR, we want to make sure Users are always delighted. Clinicians and Organizations may rate and review each other at the end of every opportunity. We receive information about ratings and reviews and, as we explain below, give Organizations information about Clinicians ratings and reviews and vice versa.
  7. Address Book Contacts. If you permit EaseEHR to access the address book on your device through the permission system used by your mobile platform, we may access and store names and contact information from your address book to facilitate invitations and social interactions that you initiate through the Solutions and for other purposes described in this privacy policy or at the time of consent or collection.
  8. Information from Cookies and Similar Technologies. EaseEHR collects information through the use of "cookies", tracking pixels, and similar technologies to understand how you navigate through the Solutions and interact with EaseEHR advertisements, to learn what content is popular, and to save your preferences. Cookies are small text files that web servers place on your device; they are designed to store basic information and to help websites and apps recognize your browser. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be accessed every time you use the Solutions. You should consult your web browser(s) to modify your cookie settings. Please note that if you delete or choose not to accept cookies from us, you will be missing out on certain features of the Solutions.

  1. Information We Collect from Third Parties

  1. Third Party Services. If you choose to register for EaseEHR or otherwise link your EaseEHR account with a third party's service (such as Gmail), we may receive the same type of information we collect from you (described above) directly from those services.
  2. Third Party Partners. We may receive additional information about you, such as demographic data, payment information, or fraud detection information, from third party partners and combine it with other information that we have about you.
  3. Enterprise Programs. If you are associated with a company, university, or organization, and the company, university, or organization participates in one of our enterprise programs, we may receive information about you, such as your email address, from your participating organization.

  1. Tracking and Do-Not-Track Settings

  1. We track User's online activities over time and across third-party websites or online services.
  2. We support the Do Not Track (DNT) browser setting. DNT is a preference User can set in User's browser's settings to let the websites User visits know that User does not want the websites collecting User's personal information.

  1. HOW DO WE USE YOUR INFORMATION?

We use the information that you provide to:

  1. Personalize User experience in using our Platform;
  2. Provide Users with information, products, or services requested from us;
  3. Present our Website, App, and Platform and their contents to Users;
  4. Provide Users with notices about account and/or subscription, including expiration and renewal notices;
  5. Carry out obligations and enforce rights arising from contracts entered into between Users and us, including billing and collection;
  6. Notify Users about changes to our Website, App, and Platform and any products or services;
  7. Allow Users to participate in interactive features on our Website, App, and Platform;
  8. Improve the Website, App, and Platform;
  9. Improve our customer service;
  10. Administer contests, promotions, and surveys or other Website, App, and Platform features;
  11. Process transactions;
  12. Anonymize data and aggregate data for statistics and Artificial Intelligence (AI);
  13. Work with third-party services to bring You additional benefits through products and services.
  14. Contact Users about our products and services that may be of interest; and
  15. Send User periodic emails, in accordance with the CAN-SPAM Act of 2003 as detailed in Section 12, via the email address provided by User to
  1. send information, respond to inquiries, and/or other requests or questions;
  2. process orders and send information and updates pertaining to such orders;
  3. send additional information related to User’s product and/or service; and
  4. market to our mailing list or continue to send emails to User after the original transaction has occurred.

  1. YOUR CHOICES

  1. Email Subscriptions. User can always unsubscribe from our commercial or promotional emails but we will still send User transactional and relational emails about User's account use of the Solutions.
  2. Text Messages. When User opts-in to the texting service, we will send User an SMS message to confirm User's signup. User can cancel the SMS service at any time. Just text "STOP" to 299377. After User sends the SMS message "STOP" to us, we will send User an SMS message to confirm that User has been unsubscribed. After this, User will no longer receive SMS messages from us. If User wants to join again, User just signs up as User did the first time and we will start sending SMS messages to User again. After User sends the SMS message "HELP" to us, we will respond with instructions on how to use our service as well as how to unsubscribe. We are able to deliver messages to the following mobile phone carriers: Major carriers: AT&T, Verizon Wireless, Sprint, T-Mobile, U.S. Cellular, Alltel, Boost. Mobile, Nextel, and Virgin Mobile. Minor carriers: Alaska Communications Systems (ACS), Appalachian Wireless (EKN), Bluegrass Cellular, Cellular One of East Central IL (ECIT), Cellular One of Northeast Pennsylvania, Cincinnati Bell Wireless, Cricket, Coral Wireless (Mobi PCS), COX, Cross, Element Mobile (Flat Wireless), Epic Touch (Elkhart Telephone), GCI, Golden State, Hawkeye (Chat Mobility), Hawkeye (NW Missouri), Illinois Valley Cellular, Inland Cellular, iWireless (Iowa Wireless), Keystone Wireless (Immix Wireless/PC Man), Mosaic (Consolidated or CTC Telecom), Nex-Tech Wireless, NTelos, Panhandle Communications, Pioneer, Plateau (Texas RSA 3 Ltd), Revol, RINA, Simmetry (TMP Corporation), Thumb Cellular, Union Wireless, United Wireless, Viaero Wireless, and West Central (WCC or 5 Star Wireless). As always, message and data rates may apply for any messages sent to User from us and to us from User. If User has any questions about User's text plan or data plan, it is best to contact User's wireless provider.   3. Push Notifications. User can opt out of receiving push notifications through User's device settings. Please note that opting out of receiving push notifications will impact User's use of the Solutions.
  4. Profile Information. While User's name will always be shared with other Users, User can delete any additional information that User added to User's profile at any time if User doesn't want other Users to see it. Organizations will always be able to see Clinicians' names, rating, and profile photos.
  5. Location Information. While Clinician can prevent Clinician's device from sharing location information at any time through Clinician's device's operating system settings, Clinician's location is core to the Solutions and without it we can't provide our services to Clinician.
  6. Editing and Accessing Your Information. You can review and edit certain account information by logging in to your account settings and profile. If would like to terminate your EaseEHR account, please contact us by email info@easeehr.com with your request. If you choose to terminate your account, we will deactivate it for you but may retain information from your account for a certain period of time and disclose it in a manner consistent with our practices under this Privacy Policy for accounts that are not closed. We also may retain information from your account to collect any fees owed, resolve disputes, troubleshoot problems, analyze usage of the Solutions, assist with any investigations, prevent fraud, enforce our Terms of Service, or take other actions as required or permitted by law.

  1. HOW DO WE PROTECT INFORMATION WE COLLECT?

  1. Security Measures.  Our Website and App use an SSL certificate as one security measure.  We also require username and passwords for our employees who can access the personal information of Users that we store and/or process on our Platform and servers. In addition, we actively prevent third parties from getting access to the personal information of Users that we store and/or process on our Platform and servers.  We accept payment by credit card and use a third party credit card processor.  We will implement reasonable security measures every time you (a) place an order, or (b) enter, submit, or access your information, (c) register, or (d) access our Platform, on our Website and App.  Furthermore, we require a personal identification number (“PIN”) before accessing PHI.  

  1. Financial Information. We store financial information on our servers, including credit card information on our servers, but we will not keep such sensitive information for longer than is needed.  We will also delete such information within fourteen (14) days of the cancelation or termination of service.  

  1. Health and Medical Information.  We store personal information such as PHI on our servers, and such information is stored indefinitely.  We will provide you with a list of such personal information we keep on you upon request.  We will delete all such personal information upon request.

  1. DATA SECURITY MEASURES.

  1. Security Measures.  We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls.  The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Platform, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Platform. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website, App, and/or Platform.

  1. Fair Information Practice Principles.  In the event of a data breach, we will notify the User within seven (7) days via (i) email and/or (ii) our Platform notification system on our Website and/or App.  We will also notify the FTC, FCC, and/or state regulatory agency as necessary. We agree to the individual redress principle, which requires that individuals have a right to pursue legally enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that that individuals have recourse to courts or a government agency to investigate and/or prosecute non-compliance by data processors.

  1. DISCLOSURE OF PERSONAL INFORMATION

Disclosure of Personal Information.

  1. We do not sell, trade, rent, or otherwise transfer personal information to others, unless we provide you with advance notice.  This does not include website hosting partners and other parties who assist us in operating our Website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential.  
  2. We may disclose aggregated information about our Users that does not identify any individual without restriction.
  3. We disclose personal information to contractors, services providers, and other third parties. We use third parties who have access to our Users’ personal information to perform some of the operational functions, such as billing and collection, to provide full service to our Users.
  4. We require all contractors, service providers, and other third parties to whom we disclose Users’ personal information to be under contractual obligations to keep personal information confidential and to use it only for the purposes for which we disclose them.
  5. We will disclose personal information in the event of a merger, sale of business, etc.
  6. We require all third parties to whom we disclose Users’ personal information to be under contractual obligations to keep personal information confidential and use such personal information only for the purposes for which we disclose it to them.
  7. We disclose personal information to fulfill the purpose for which the User provided it, for instance, if the User gave EaseEHR an email address to use the “email a friend” feature of the Platform.
  8. We disclose personal information for any other purpose for which the User provided it.
  9. We will only disclose personal information as described in this Privacy Policy or with the written consent of the User.

Other Disclosure of Personal Information.

  1. We will disclose personal information (i) to comply with any court order, law or legal process, including to respond to any government or regulatory request; (ii) to enforce or apply our Online Agency Agreement, Online Contractor Agreement, and Website Terms of Use;  (iii) if we believe it is necessary or appropriate to protect the rights, property, or safety of EaseEHR, our customers or others; and/or (iv) if it is necessary or appropriate to protect the rights, property, or safety of EaseEHR, our customers, or others, and this includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

Disclosure of Users’ Information for Third-Party Advertising.  

  1. Users can opt-out (i) by checking the relevant form when we collect the data; (ii) by logging into our Website, App, or Platform and adjusting their preferences in their account profile; or (iii) by emailing us their request at info@EaseEHR.com.  

  1. Users receiving promotional email can opt-out by sending a return email requesting to be omitted from future promotional email distributions. This opt-out will not apply to information provided by EaseEHR for product purchases, warranty registration, or other transactions.    

  1. GOOGLE ANALYTICS

We currently use Google Analytics to collect and process certain Website usage data. To learn more about Google Analytics and how to opt-out, please visit www.policies.google.com/privacy/partners.

  1. YOUR CALIFORNIA PRIVACY RIGHTS

EaseEHR does not sell, trade, or otherwise transfer to outside third parties your “Personal Information” as the term is defined under the California Civil Code Section § 1798.82(h).  Additionally, California Civil Code Section § 1798.83 permits Users of our Website, App, or Platform that are California residents to request certain information regarding our disclosure of their Personal Information to third parties for their direct marketing purposes. To make a request for such disclosure, or identification and/or deletion of Personal Information in all our systems that we store on you, please send an email to info@EaseEHR.com or write us at EaseEHR, 5084 Melbourne Dr, Cypress, CA 90630.

Note that (i) if we delete your Personal Information as requested, we will no longer be able to provide our services to you and (ii) we may need to keep such Personal Information for a while during the shutting down and billing process.   1. COPPA COMPLIANCE (FOR CHILDREN UNDER 13 USERS ONLY)

The Children’s Online Privacy Protection Act (“COPPA”) is a legislation that applies to entities that collect and store personal information from children under the age of 13. We are committed to ensure compliance with COPPA. Our Website, App, and Platform are not meant for use by children under the age of 13. Our Website, App, and Platform do not target children under the age of 13, but we do not age screen or otherwise prevent the collection, use, and personal disclosure of persons who are under 13.  If you would like to know more about our practices and specifically our practices in relation to COPPA compliance, please email us at info@EaseEHR.com.

  1. CAN-SPAM ACT OF 2003

The CAN-SPAM Act establishes requirements for commercial messages, gives recipients the right to have businesses stop emailing them, and spells out penalties for violations.  Per the CAN-SPAM Act, we will:

  1. not use false or misleading subjects or email addresses;
  2. identify the email message as an advertisement in some reasonable way;
  3. include the physical address of EaseEHR, which is located at 5084 Melbourne Dr, Cypress, CA 90630;
  4. monitor third-party email marketing services for compliance, if one is used;
  5. honor opt-out/unsubscribe requests quickly; and
  6. give an “opt-out” or “unsubscribe” option.    

If you wish to opt-out of email marketing, follow the instructions at the bottom of each email and we will promptly remove you from all future marketing correspondences.

  1. TERRITORIAL RESTRICTION

Our Website, App, and Platform are only available for use and download outside the European Union. Our Website, App, and Platform are not available for use or download by residents of, visitors to, or employees of our customers, who reside in the European Union (collectively a “European”). If you are a European, please do not download, register, and/or use the Website, App, or Platform. If you are a resident in the United States of America (“US”), you must comply with this Privacy Policy and the Online Agency Agreement or the Online Contractor Agreement.   If you are a resident of any other country, please ensure compliance with all local laws prior to using our Website, App, or Platform.

  1. MODIFICATIONS TO OUR PRIVACY POLICY

EaseEHR reserves the right, at its sole discretion, to change or modify this Privacy Policy at any time. In the event, we modify this Privacy Policy, such modifications shall be binding on you only upon your acceptance of the modified Privacy Policy.  We will inform you about the modifications on our Privacy Policy page. Your continued use of our Website, App, or Platform shall constitute your consent to such changes.
